Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Wone application and related services (collectively, the “Service”) operated by PRFM Health & Performance Private Limited (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Wone is an athletic coordination platform that creates verified race profiles by retrieving official results from public timing platforms. The Service enables athletes, clubs, and race organizers to maintain accurate race histories and coordinate within the endurance sports ecosystem.

Key features include:

• Automatic detection of race participation through authorized Gmail access
• Retrieval and display of official race results from public timing platforms
• Athletic profile management and race history tracking
• Club coordination and member management tools
• Integration with third-party fitness platforms (e.g., Strava)

To use the Service, you must create an account using Google Sign-In. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

Wone requests read-only access to your Gmail account to identify race-related emails. By granting this access, you understand and agree that:

• Wone will scan your Gmail inbox for race registration and result notification emails
• Email content is processed transiently in memory and is not stored
• Only race identifiers (race name, date, bib number, timing platform) are extracted
• Extracted identifiers are used solely to retrieve official results from public timing platforms and are discarded after retrieval
• Wone does not modify, send, or delete any emails
• You may revoke Gmail access at any time through the app settings or your Google Account permissions page

Gmail access is optional. You may use certain features of the Service without granting Gmail access, though automatic race detection will not be available.

You agree to use the Service in compliance with all applicable laws and regulations. You shall not:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the integrity or performance of the Service
• Create false or misleading athletic profiles or race results
• Impersonate another person or misrepresent your affiliation with any entity
• Use automated means (bots, scrapers) to access the Service without written permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to harass, abuse, or harm other users

Wone retrieves race results from public timing platforms and presents them as part of your athletic profile. You acknowledge that:

• Race results displayed on Wone originate from third-party timing platforms and are presented as received
• Wone does not independently verify the accuracy of results provided by timing platforms
• Wone may display verification indicators reflecting the source and reliability of results
• You may report inaccurate results for review and correction
• We reserve the right to remove or flag results that we reasonably believe to be fraudulent or inaccurate

If you join or manage a club on Wone:

• Club administrators may view members’ public athletic profiles and race histories
• Your public race results and club affiliation may be visible to other club members
• Club administrators are responsible for managing their club’s membership and content in accordance with these Terms
• We reserve the right to remove clubs or club content that violates these Terms

The Service, including its design, features, code, and content (excluding user-generated content and third-party race data), is owned by Wone and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written consent.

You retain ownership of any content you submit to the Service (profile information, photos, etc.). By submitting content, you grant Wone a non-exclusive, royalty-free license to use, display, and distribute such content solely in connection with the operation of the Service.

The Service integrates with third-party platforms including Google (Gmail), Strava, and various race timing platforms. Your use of these integrations is subject to the respective third party’s terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

We do not guarantee the availability, accuracy, or reliability of third-party services. Timing platform data is presented as received and may be subject to delays or errors beyond our control.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Race results retrieved from timing platforms will be accurate or complete
• The Service will meet your specific requirements
• Any defects in the Service will be corrected

To the maximum extent permitted by applicable law, Wone shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount you have paid to Wone in the twelve (12) months preceding the claim, or INR 5,000, whichever is greater.

You agree to indemnify and hold harmless Wone, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third party’s rights.

You may terminate your account at any time by deleting your account within the app. We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms.

Upon termination:

• Your right to access and use the Service will cease immediately
• All data associated with your account will be deleted in accordance with our Privacy Policy
• Sections 8, 10, 11, 12, 14, and 15 shall survive termination

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at the email address provided below. We will attempt to resolve the dispute within 30 days of receiving your notice.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms within the app and updating the effective date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

If you do not agree to the modified Terms, you must stop using the Service and delete your account.

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Wone regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
